Terms of Service

1. Acceptance of Terms

By creating an account or using MoxiVoice in any way, you confirm that you are at least 13 years old, have the legal capacity to enter into this agreement, and accept these Terms. If you are using MoxiVoice on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. The Service

MoxiVoice provides AI-powered voice translation, speech-to-text, and text-to-speech services accessible via our web application at moxivoice.com. The service is provided on a subscription basis with credit-based usage metering.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at info@moxivoice.com if you suspect unauthorised access to your account.

You may not create accounts by automated means, use false identity information, or create accounts for purposes other than using MoxiVoice as intended.

4. Subscriptions & Credits

MoxiVoice operates on a subscription model with usage measured in credits. Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except where required by applicable law.

• Credits are allocated per billing cycle and do not roll over to the next period unless otherwise stated in your plan.
• Free trial credits are provided to new accounts at registration and are subject to expiry.
• If your subscription lapses or you exhaust your credits, access to paid features will be suspended until renewal or top-up.

We reserve the right to change pricing with 30 days notice. Continued use after the notice period constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to use MoxiVoice to:

• Violate any applicable law or regulation
• Infringe any intellectual property or privacy rights of third parties
• Transmit or process content that is defamatory, obscene, hateful, or harassing
• Generate or distribute spam, phishing, or fraudulent content
• Reverse engineer, decompile, or attempt to extract source code from MoxiVoice
• Circumvent or attempt to circumvent usage limits or access controls
• Use automated tools to access the service in a manner that places unreasonable load on our infrastructure
• Resell or sublicense access to the service without our prior written consent

6. Your Content

You retain ownership of any audio, text, or other content you submit to MoxiVoice ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive licence to process, transmit, and store it solely for the purpose of providing the service to you.

You represent and warrant that you have all necessary rights to submit Your Content and that it does not violate any third-party rights or applicable laws. You are solely responsible for Your Content.

7. Intellectual Property

MoxiVoice and its underlying technology, design, trademarks, and content (excluding Your Content) are the property of Moxitek Pty Ltd or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Third-Party Services

MoxiVoice integrates with third-party services to deliver its features (including speech recognition, translation, and text-to-speech providers). These services are subject to their own terms and privacy policies. We are not responsible for the practices of any third-party services.

9. Disclaimer of Warranties

MoxiVoice is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that translations will be accurate or suitable for any particular purpose.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Moxitek Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of MoxiVoice.

Our total cumulative liability to you for any claims arising from these Terms or your use of MoxiVoice shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

You may terminate your account at any time by contacting us at info@moxivoice.com or through your account settings.

We may suspend or terminate your access immediately if you breach these Terms, if we are required to do so by law, or if continued provision of the service is no longer commercially viable. Upon termination, your right to use MoxiVoice ceases immediately.

12. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Australia.

13. Changes to Terms

We may update these Terms at any time. We will provide at least 14 days notice of material changes by email or by posting a notice within the service. Continued use after the notice period constitutes acceptance of the revised Terms.
